The Northwest Territories requires an inspection at both ends of a tenancy, each with a written report, and ties the deposit to them: without both reports, nothing can be kept for damage. Here is each rule with a link to the territory's Residential Tenancies Act, and how walkthrough notes become entry and exit reports that meet it.

What Northwest Territories requires

The entry inspection and report

At the beginning of a tenancy, the landlord or an agent inspects the condition and contents of the rental premises and offers the tenant reasonable opportunities to take part. Right after, the landlord prepares and signs an entry inspection report and gives the tenant the chance to add comments and sign it.

The report may be in the approved form, and the Rental Office publishes one, but the Act does not make it mandatory. A report that covers each room's condition and contents, with room for the tenant's comments and both signatures, does the same job.

The exit inspection and report

At the end of a tenancy, the landlord or agent inspects the vacated premises and again offers the tenant reasonable opportunities to take part. If the tenant abandoned the premises, the inspection happens within one week after the landlord learns of it, with or without the tenant.

The exit report is prepared and signed right after, and a tenant who took part gets the chance to comment and sign. For both reports, the tenant receives a copy within five days, and the landlord keeps the report for at least 18 months after the tenancy ends and shows it to a rental officer on request.

No reports, no damage deductions

A landlord may not keep any of a security deposit or pet security deposit for damage repairs if the entry and exit reports were not completed, or if the tenant did not get a copy of each, unless a rental officer accepts a reasonable excuse. Deductions are otherwise allowed for rent arrears and for repairing damage caused by the tenant or someone the tenant let in.

Within 10 days after the tenant leaves, the landlord either returns the deposit with an itemized statement of account, or gives written notice of the intention to withhold with itemized statements of the deposit, any rent arrears and any repairs, and returns the balance. Where repair costs are not known in time, an estimate goes with the notice and the final statement follows within 30 days.

From walkthrough notes to finished NWT reports

Walk the unit with the tenant if they accept, noting each room's condition and the contents the landlord supplies. ReportDraft writes it up as a room-by-room report with a space for the tenant's comments, lines for the landlord or agent and the tenant to sign, and the date the copy went to the tenant in the header.

Use the same rooms and items at the exit inspection, so the two reports show exactly what changed.

Common mistakes

  • Skipping the entry inspection report, which rules out any deduction for damage at the end.
  • Inspecting without offering the tenant a reasonable chance to take part.
  • Giving the tenant their copy more than five days after the inspection.
  • Discarding reports before 18 months after the tenancy ends.
  • Missing the 10 days to return the deposit or give written notice with itemized statements.
