Saskatchewan rules for this report
These rules are about how and when you report, not the template's fields. Check them before you deliver.
- Within seven business days after the landlord knows or should reasonably have known the tenant vacated, the landlord pays back the deposit with any interest, or pays back the part not claimed, serves notice in the approved form of the intention to keep the rest, and holds that amount in trust for 30 days from the end of the tenancyThe Residential Tenancies Act, 2006 (Sask.), s. 32 (1) · Government of Saskatchewan, Security Deposits
- The notice goes to the forwarding address the tenant gave at the end of the tenancy, in person, by ordinary mail or electronically; if no forwarding address was given, no notice is requiredThe Residential Tenancies Act, 2006 (Sask.), s. 32 (1.1) and (2)
- When a tenant vacates, they leave the rental unit reasonably clean and undamaged, except for reasonable wear and tear, and give the landlord all keys and other means of access they holdThe Residential Tenancies Act, 2006 (Sask.), s. 51
- Those steps do not apply where, when the tenancy ends, the tenant agrees in writing that the landlord may keep all or part of the deposit and the landlord pays back any part not claimedThe Residential Tenancies Act, 2006 (Sask.), s. 32 (4)
- A tenancy agreement cannot say the landlord will automatically keep all or part of the deposit at the end of the tenancy; a claim goes through the Office of Residential TenanciesGovernment of Saskatchewan, Security Deposits
- If the landlord does not follow these steps or the tenant disputes the claim, the tenant may apply to the director for an order on the deposit within 60 days after the tenancy endsThe Residential Tenancies Act, 2006 (Sask.), s. 33 (1) and (2) · Government of Saskatchewan, Security Deposits
- When the tenancy ends because of the landlord's notice for the landlord's own use of the property under clause 60 (7) (a) or (b), the deposit is returned without deduction, apart from claims for rent and utility arrearsThe Residential Tenancies Act, 2006 (Sask.), s. 32 (5)
