Manitoba rules for this report

These rules are about how and when you report, not the template's fields. Check them before you deliver.

  • Only a trained service technician, certified by the minister after an approved course in repair, installation, recovery and recycling for sealed systems, may install, repair or service air conditioning or refrigeration equipment (or a white good) that contains a Class 1, 2 or 3 substance, which includes CFCs, HCFCs and all HFCs; each technician has a certification number, renewed every year by June 1M.R. 103/94, ss. 4 (2), 6, 20 (1), (3), (4), Schedule (Class 3)
  • No one may charge, recharge or top up equipment containing a Class 1, 2 or 3 substance without first leak testing it (for air conditioning and refrigeration, by the Manitoba Ozone Protection Industry Association's compliance guide procedure); a leak found must be repaired immediately so it can no longer leak, or the refrigerant immediately recovered and the equipment disabled. Refrigerant may never be added to flush equipment or to leak test itM.R. 103/94, ss. 11, 12
  • For every installation, repair or service, the technician completes a record on the minister's form showing the type of equipment and work, the date and location, whether refrigerant was removed, recovered, charged or recharged and its type, and any amount stored for recycling, reclamation or destruction and where; a copy is left with the owner or operator, the record is kept three years and shown to an environment officer on request, and a yearly summary goes to the minister before February 1M.R. 103/94, s. 8 (1) to (4)
  • Whoever recharges labelled equipment affixes a new label showing the type and amount of refrigerant used, the date, the name of the person or business, and the certificate number of the trained service technician who recharged itM.R. 103/94, s. 25 (2)
  • No one may release a Class 1, 2 or 3 substance into the environment except as an enactment allows; a technician doing the work has operational recovery equipment at the job site, recovers refrigerant that would otherwise be released (for air conditioning and refrigeration, under the ARI 740 recovery equipment standard) and reuses, recycles, reclaims or arranges for its destructionM.R. 103/94, ss. 5 (1), 7
  • Contravening the regulation, or obstructing an environment officer, is an offence under The Ozone Depleting Substances ActThe Ozone Depleting Substances Act, C.C.S.M. c. O80, s. 7
